Rustico Beer Popsicle Controversy

It's not really my intention to post news on here, but I was at Rustico last night, and Greg told me about this problem they'd had with beer popsicles. In short, they'd been making popsicles from beer (mostly fruity lambics), which apparently isn't legal in Virginia.

Which is unfortunate, because it's a delicious sounding idea (which, of course, I didn't know about until after they'd been ordered to stop), but on the bright side, it's meant a bunch of good publicity for Rustico.

The legal issue is apparently that beer must be served in its original container, or poured in front of the customer from its original container. Which makes some sense (I've been almost served the wrong thing a few times, and it's nice to know just by looking at the bottle), I'll admit. But Rustico also cooks with their beers quite a bit, and that beer is clearly not being served in its original container. At what point are you no longer serving someone beer, and instead serving them food with beer in it?

According to Greg, Rustico's not interested in legal trouble, so they're unlikely to rock the boat on this issue. Which, again, is a shame, because beer popsicles sound really, really delicious.
